DISCIPLINARY BILL OF RIGHTS

  • The accused, in disciplinary cases, shall be innocent until proven guilty.
  • The accused shall not be compelled to witness against himself/herself.
  • The accused shall have the right to seek legal counsel. The counsel may advise the student but not present the case.
  • The accused shall have the right to question evidence presented through the hearing officer.
  • The accused shall have the right to appeal any decision of an original hearing.
  • The accused must be informed in writing of the charges against him/her at least five (5) working days, as defined by the University, prior to the hearing, except in cases in which the penalty could reasonably include suspension or expulsion. In such a case, the accused shall be notified at least seven (7) working days, as defined by the University, prior to the hearing. These time frames are contingent upon the academic calendar and the necessity to bring closure to a situation and, at the discretion of the vice president for student services or the judicial officer, may be adjusted as deemed necessary.
  • All students shall be assured procedural due process.
  • Each student shall be free from disciplinary action by University officials for violations of civil and criminal law off campus except as otherwise provided by law or applicable codes.
  • Accused students shall have the right to present their own version of the facts.
